The Director of Corporate Enforcement is studying the Supreme Court Judgment of 1st February 2008 in the matter of Tralee Beef and Lamb Limited. This Judgment has relevance to the manner in which High Court restriction proceedings are taken by liquidators against the directors of insolvent companies pursuant to their statutory obligation to do so under Section 56 of the Company Law Enforcement Act 2001.
In particular, the Director will consider whether, and to what extent, he may need to modify the practices adopted by his Office when considering cases involving the types of circumstances involved in this particular case.
