Judgment of Mr Justice Kelly delivered on 23rd March 2004 on foot of an application for the winding-up, under the Companies Acts 1963 to 2003, of Eurofood IFSC Limited - a wholly-owned subsidiary of Parmalat SpA. This case (in which the Director of Corporate Enforcement was one of the Notice Parties) was the first to be dealt with by the Irish courts where issues arose concerning the interpretation of the European Insolvency Regulation (Council Regulation (EC) 1346/2000 of 29 May 2000 on Insolvency Proceedings).

Note: This judgment was the subject of an appeal to the Supreme Court in which judgments were delivered on 27 July 2004 and in the context of which the Supreme Court has decided to seek preliminary rulings (pursuant to Article 234 of the Treaty Establishing the European Community) from the Court of Justice of the European Communities.
